Terms of Use

1. Use of the Services
The Services are provided exclusively for educational and instructional purposes within participating schools and districts. Authorized users may include teachers, students, instructional leaders, district personnel, and other individuals granted access by their school or district.
Users agree to:
- Use the Services solely for instructional, administrative, or school-related purposes
- Comply with all applicable district, school, and classroom technology-use policies
- Use the Services in compliance with relevant federal and state privacy laws, including FERPA and COPPA (per district requirements)
Users may not:
- Copy, publish, or distribute curriculum materials outside of their licensed organization
- Modify, translate, or create derivative works of the curriculum
- Attempt to gain unauthorized access to the platform or its systems
- Use the platform in any manner that disrupts or interferes with its operation
Your license to use the Services is limited, non-exclusive, non-transferable, and subject to termination upon violation of these Terms or expiration of your subscription.
2. Accounts and Security
Users may be required to create accounts to access certain portions of the Services.
You agree to:
- Provide accurate and current account information
- Maintain the confidentiality of login credentials
- Notify Alba Educational Consulting immediately if you suspect unauthorized use
Schools and districts are responsible for ensuring accounts are created, managed, and used in accordance with their policies and applicable laws.
3. Ownership of Content
All curriculum content—including lessons, assessments, digital activities, images, videos, routines, teacher guidance, templates, and associated intellectual property—is owned exclusively by Alba Educational Consulting, LLC.
Users may:
- Access, view, print, and download materials only for instructional use within their licensed school or district
- Use materials during active subscription periods as permitted by their license agreement
Users may not:
- Redistribute materials externally
- Upload or publish materials to public websites, servers, or shared drives accessible outside the licensed organization
- Use materials for commercial purposes without written permission
All rights not expressly granted are reserved.
4. Subscription Access and Licensing
Access to the Services is governed by the subscription purchased by a school or district.
Subscription terms may define:
- Duration of access
- Number of authorized users
- Grade levels and components included
- Digital and print rights
- Renewal, expiration, and upgrade procedures
Alba Educational Consulting may suspend or terminate access if a subscription expires, is canceled, or is used outside the licensed scope.
5. Student Data and Privacy
Use of the Services is also governed by our Privacy Policy, which explains how personal information—including student data—is collected, used, stored, and protected. (See the Privacy Policy last updated March 19, 2024.)
Alba Educational Consulting complies with:
- FERPA
- COPPA (as applicable, through district-directed consent processes)
- State student-data-privacy requirements
We do not sell personal information or use student data for advertising or profiling.
6. Platform Availability and Modifications
We strive to maintain uninterrupted access to the platform; however, we do not guarantee:
- Continuous operation
- Absence of errors, bugs, or outages
- Compatibility with all devices or browsers
We may update, modify, or discontinue features or components at any time.
7. Third-Party Services
Some features may rely on third-party tools or integrations (e.g., hosting providers, SSO systems). These services are governed by their own terms and policies.
Alba Educational Consulting is not responsible for failures, data handling practices, or outages caused by third-party providers.
8. Payment Terms
Subscription fees must be paid according to the invoice or contract agreed upon with the school or district.
Failure to pay may result in suspended or terminated access.
Payments processed by district-approved vendors or third-party billing systems are subject to those providers’ terms.
9. Termination of Access
Access may be suspended or terminated if:
- A user violates these Terms
- A subscription expires or is not renewed
- Required fees are not paid
- The Services are discontinued
Access to curriculum materials ends upon termination unless otherwise specified in writing.
10. Limitation of Liability
To the fullest extent permitted by law, Alba Educational Consulting, LLC is not liable for:
- Loss of data
- Business or instructional disruptions
- Platform errors, delays, or outages
- Any indirect, consequential, or incidental damages
Your sole remedy for dissatisfaction with the Services is to discontinue use.
11. Indemnification
Users agree to indemnify and hold harmless Alba Educational Consulting, LLC from any claims, damages, liabilities, or expenses arising from:
- Violation of these Terms
- Business or instructional disruptions
- Misuse of the platform or curriculum
- Unauthorized distribution or reproduction of materials
12. Not a School or Instructional Provider
Alba Educational Consulting, LLC provides curriculum content and supporting resources. We are not a school, tutoring provider, or instructional service, and we do not assume responsibility for instructional decisions, grading, student outcomes, or compliance with local school policies.
13. Changes to These Terms
We may update or revise these Terms at any time. The “Last Updated” date will reflect the most recent changes. Continued use of the Services signifies acceptance of the updated Terms.
